General Terms and Conditions
The subject matter of these General Terms and Conditions is the relationship between Swiss Paragliding & Adventure GmbH (hereinafter referred to as "Swiss-Paragliding") and
- Client and passenger (hereinafter referred to as "Customer") with regard to the performance of tandem paragliding flights (see Section A) or
- buyer and participant (hereinafter referred to as "customer") with regard to the brokerage of activities of partner companies (see section B).
A. Carrying out paragliding flights
1. services, right of substitution
Swiss-Paragliding operates tandem hang gliding flights.
The placing of an order with Swiss-Paragliding to carry out a tandem hang gliding flight is subject to the right of substitution, i.e. Swiss Paragliding is entitled to have tandem hang gliding flights booked via Swiss-Paragliding carried out by pilots who are not employees of Swiss-Paragliding. These are also not considered auxiliary persons. In this case, Swiss-Paragliding is not liable for the acts and omissions of these pilots, but only for due care in their selection and instruction.
2. conclusion of contract
The contract regarding the execution of the tandem hang gliding flight is concluded with the registration/reservation and acceptance by Swiss-Paragliding or with the voucher order. Confirmation of the booking by Swiss-Paragliding can be made in writing, by telephone or by e-mail. The flight fee must be paid at the latest when the flight ticket is handed over before departure to the flight area. The special provisions regarding the online ordering of vouchers remain reserved (see section C.1.).
3. vouchers
Vouchers are generally redeemable within the validity period of the voucher for all Swiss-Paragliding tandem hang gliding flights, even if a specific flying area is specified in the voucher. If the flight area is no longer available, Swiss-Paragliding may switch to another flight area. In all other respects, the provisions of section C.1 apply.
4. flight, flight duration and landing site
The description of a tandem hang gliding flight on the Swiss-Paragliding website is correct at the time of posting. However, the content of the flight may be subject to change, and Swiss-Paragliding will endeavor to update any changes in the general description. The photos, images and videos used in connection with the flights offered serve only to describe the flight in question. The images are therefore non-binding and may vary.
The flight times stated on the Swiss-Paragliding website are indicative. Swiss-Paragliding does not guarantee flight times. This depends on the weather conditions and may differ from the times stated on the Swiss-Paragliding website. The same applies to the landing site indicated on the website. This can be freely chosen by the pilot according to the wind and weather conditions. A shorter flight duration or the abortion of a flight and/or landing at a different landing site does not entitle the pilot to a price reduction.
5. appointment
The date of the flight will be coordinated with Swiss-Paragliding at short notice and agreed depending on suitable weather conditions. It is expressly pointed out that despite firmly agreed dates, there is no entitlement to a tandem hang gliding flight if the weather conditions do not permit this.
In the event of postponement or cancellation, there is no entitlement to compensation, reimbursement of the flight fee (subject to clause 7) or reimbursement of other expenses incurred. The right to reschedule the flight remains unaffected. If the customer does not take part in the tandem paragliding flight or leaves the activity prematurely, the entitlement to benefits lapses.
Arrival and departure to the flight area are the responsibility of the customer.
6 (Cooperation) obligations of the customer
The customer expressly declares that he/she is physically and mentally healthy, has no heart or circulatory disorders, balance problems, nervous disorders or other illnesses, including chronic illnesses, and feels able to cope with the strain of a paragliding flight. If there are any uncertainties, it is the customer's responsibility to have their fitness confirmed by a doctor.
The customer undertakes to cancel the flight if there is no theoretical introduction or if he has not understood it in whole or in part; furthermore, if he is under the influence of alcohol, drugs or medication.
The customer undertakes to wear appropriate clothing (weather and windproof, suitable for dirt) and, if possible, sturdy shoes and the helmet provided by the pilot.
Passengers under the age of 16 require the consent of a parent or legal guardian. If no legal guardian is present, consent must be given in writing.
The customer undertakes to follow the pilot's instructions immediately and without fail. This is for his own safety. In particular, failure to follow the theoretical introduction and instructions during take-off, flight and landing may endanger the passenger and pilot. In the event of non-compliance with the pilot's instructions, the pilot may exclude the customer from flying with Swiss-Paragliding or abort the flight.
7. withdrawal by the customer before the start of the activity
Cancellation must be made in writing, enclosing the documents received (tickets, programs, etc.). The date of receipt of the notification (on Sundays and public holidays the next working day) at the booking office is decisive for calculating the cancellation costs.
The date of the activity can be changed up to 5 days before the activity at the latest.
If the date is changed before the activity and or the activity is canceled, a processing fee of CHF 40 per booked service & person will be charged.
In addition to the administration fees, the following cancellation fees will be charged for the booked service.
14 - 07 days before the start of the activity, 25% + 40 CHF per person
07 - 05 days before the start of the activity, 50% + 40 CHF per person
02 - 00 days before the start of the activity 100%
If the customer is unable to participate in the activity due to late arrival, or can only participate to a limited extent, no refund will be made.
8. cancellation of the tandem paragliding flight after the customer's arrival at the flight area
The pilot is responsible for the execution of the flight and determines the details.
The pilot is entitled to cancel the tandem paragliding flight if the customer gives justified cause to do so through actions or omissions or violates his obligations to cooperate (see section 6). As a result, the entitlement to the service expires without entitlement to a refund of the flight fee.
If flight operations have to be suspended due to force majeure (e.g. natural disasters, epidemics, unrest), official measures or strikes, or if the flight is canceled or aborted due to weather conditions, safety or other reasons that make the tandem paragliding flight considerably more difficult, dangerous or impossible, the flight fee already paid will be refunded. Further claims, in particular those for other expenses incurred, are excluded.
If a tandem hang gliding flight cannot be carried out in the desired flight area for the reasons mentioned in the previous section, Swiss-Paragliding is entitled, but not obliged, to switch to another flight area. Any price difference in favor of the customer will be refunded. Switching to another flying area is not permitted without the customer's consent if the customer has specifically indicated at the time of booking that they wish to carry out the tandem paragliding flight exclusively in the booked flying area.
9. insurance
The passenger acts at his own risk and is not insured by Swiss-Praragliding.
Paragliding is not considered a high-risk sport in Switzerland. Accidents are covered by Swiss accident insurance in accordance with the UVG. It is the sole responsibility of the customer to clarify whether he has the necessary insurance and, if necessary, to take out such insurance.
10. complaints by the customer
Complaints by the customer must be made in writing to Swiss-Paragliding immediately after the tandem paragliding flight and confirmed. Confirmation by Swiss-Paragliding does not constitute acknowledgement of fault. Auxiliary persons of Swiss-Paragliding are not authorized to acknowledge claims.
Any claims for damages must be made in writing to Swiss-Paragliding within four weeks of the tandem hang gliding flight taking place.
If no complaint is made immediately and/or no claims for compensation are made in due time, any claims shall be deemed forfeited and waiver shall be assumed.
11. liability and exclusions of liability
Transportation during tandem paragliding flights is not subject to the liability provisions of the Ordinance on Air Transport of 17.08.2005. The liability of Swiss-Paragliding or the pilot towards the customer is contractually limited to CHF 72,500 for personal injury and CHF 2,000 for damage to property when the flight ticket is issued. Any further liability, in particular for auxiliary persons and for indirect and consequential damages, such as loss of profit, third-party claims, etc., is hereby expressly excluded to the extent permitted by law.
Furthermore, the following special exclusions of liability apply:
- If Swiss-paragliding delegates the execution of the tandem paragliding flight to a third party (see section 1), it is not liable for the actions and omissions of the third party. In particular, Swiss-Paragliding shall not be liable for damages resulting from actions and omissions of the pilot that are not related to the contractually agreed service.
- Swiss-Paragliding is not liable for damages resulting from a breach of the customer's duty to cooperate (see section 6).
- Swiss-Paragliding is not liable for damages caused by the actions of third parties or other participants, force majeure, natural events, official orders, etc.
The above limitations and exclusions of liability also apply to non-contractual liability claims of the customer.
12. image and film material
The photos and videos taken on Swiss-Paragliding flights are the copyrighted property of Swiss-Paragliding. Swiss-Paragliding is entitled to use this material for advertising purposes, even if the customer can be recognized on it, without incurring any costs for Swiss-Paragliding towards the customer.
B. Mediation of activities of partner companies
1. services
Swiss-Paragliding arranges activities of various organizers on its website or on site by selling vouchers / tickets for these activities.
2. conclusion of contract
The purchase contract (for the voucher tickets) between Swiss-Paragliding and the customer is concluded when the customer accepts the GTC during the ordering process and sends the voucher order online.
The organizer is solely responsible for carrying out the activity. After purchasing a voucher/ticket, the customer is obliged to arrange a date for the activity with the organizer. In the course of the ordering process, the customer will receive the necessary contact details for the relevant organizer.
The contract regarding the booking and execution of the respective activity is concluded directly between the customer and the respective organizer. The fulfillment of the booked service does not constitute a performance obligation on the part of Swiss-Paragliding. Swiss-Paragliding merely acts as an agent for the activities presented on its website or on site. Accordingly, the General Terms and Conditions of the respective organizer apply to the performance of the activities for which the voucher/ticket entitles the holder to book. Important content from these (e.g. exclusion criteria, dates, locations) can be found in the description of the activities in the corresponding offer on the Swiss-Paragliding website.
3. vouchers / tickets
Vouchers / tickets entitle the customer to book and carry out the activity mentioned in the voucher with the organizer within the period of validity of the voucher. The price stated in the voucher/ticket and the booking conditions stated at the time of booking apply. Otherwise, the provisions of section C.1 apply.
4. activities
The description of an activity on the Swiss-Paragliding website is correct at the time it is posted. However, the content of the activity may be subject to change, and Swiss-Paragliding will endeavor to update any changes in the general description. The photos, images and videos used in connection with the activities offered serve only to describe the activities in question. The images of the vehicles, aircraft and locations, etc. are therefore non-binding and may vary.
The times published on the Swiss-Paragliding website for each activity are indicative, may vary and are not binding. The activities may be carried out in groups. Waiting times must be expected.
Claims for damages due to incorrect illustrations, texts and prices or late delivery are excluded.
5. making an appointment
Participation in the activities is subject to availability. The customer agrees the final date with the organizer, who informs the customer of available dates. It is advisable to book in good time, at least 14 days before the planned date.
If a date has been agreed for the activity and the customer does not show up, the voucher expires without replacement. The customer must agree postponements with the organizer in good time and inquire about any fees that may be incurred in the event of postponements or cancellations at short notice. Corresponding regulations are a matter between the customer and the organizer. If such fees are due, they are to be paid by the customer directly to the organizer.
Many activities are subject to weather conditions. The customer will be informed of this in the activity descriptions. It may be necessary to check the weather conditions with the organizer shortly before or on the day of participation. The customer must obtain this information directly from the organizer. If the activity cannot be carried out due to the weather conditions, the customer can rebook the date for participation in the activity directly with the organizer. In this case, Swiss-Paragliding shall not assume the costs and expenses incurred by the customer in connection with the attempted or renewed redemption of the booked activity (e.g. travel costs, accommodation, escorts, vacation, etc.).
6. participation requirements
The minimum requirements can be found in the description of the respective activity. Participation in an activity may require the fulfillment of personal requirements (e.g. height, age, state of health, weight, fitness, driving license). The customer is aware of these requirements from the description of the activities. They are also responsible for ensuring that they meet the minimum requirements to take part in the activity in question. A refund of the booking price is excluded if the participation requirements are not met.
7. cancellation
If a specific vehicle or technical equipment or the participation of a specific person is included in the description of an activity and this vehicle, technical equipment or person is not available on the day of participation in the activity, the organizer reserves the right to provide an appropriate replacement. If this is not possible, the organizer reserves the right to cancel the activity, even at short notice. Further information on this can be found in the terms and conditions of the respective organizer. In this case, the voucher/ticket remains valid.
8. changes to the service
Deviations in content and changes to individual activities after the purchase of a voucher will only be made if necessary, provided they are not substantial and do not significantly affect the overall content and effect of the booked activity. Changes to the booked experience will be communicated to the purchaser as soon as Swiss-Paragliding becomes aware of them.
In the event of a significant change to the content of an activity, the customer is entitled to withdraw from the purchase contract free of charge, provided that the voucher/ticket has not already been redeemed, or - if offered by Swiss-Paragliding - to choose a voucher for another equivalent activity.
9. insurance
Insurance is the responsibility of the customer.
10. liability
Liability for damages resulting from slightly negligent actions, for actions of auxiliary persons and for indirect and consequential damages, such as loss of profit, claims of third parties, etc., is completely excluded.
Furthermore, the following special exclusions of liability apply:
- Swiss-Paragliding is not liable for damages caused by actions or omissions of the organizer or his assistants.
- Descriptions and image/video material on the Swiss-Paragliding website or in Swiss-Paragliding's advertising material do not constitute a guarantee by Swiss-Paragliding to the customer and do not form part of the agency contract.
- Swiss-Paragliding assumes no liability for the topicality, correctness, legality, completeness or quality of the content of websites that can be accessed via links on the Swiss-Paragliding website.
The above limitations and exclusions of liability also apply to non-contractual liability claims of the customer.
11. withdrawal by Swiss-Paragliding
Until the customer has booked an activity with the organizer, Swiss-Paragliding is entitled to withdraw from the contract for good cause. An important reason is, for example
- the organizer is no longer a partner company of Swiss-Paragliding or has generally ceased trading;
- the minimum number of participants stated in the description of the experience is not reached;
- the organizer cannot reasonably be expected to carry out the activities;
- force majeure.
If one of these cases occurs, Swiss-Paragliding will inform the customer immediately.
In the event of withdrawal from the contract for good cause, the customer will be refunded the booking price paid to Swiss-Paragliding immediately. The customer also has the option of booking an equivalent experience from the Swiss-Paragliding offer. Further claims against Swiss-Paragliding, in particular claims for damages (e.g. travel costs, accommodation), are excluded.
C. Common provisions
1. vouchers
Even if the vouchers are registered, they are not personal and are therefore freely transferable. Swiss-Paragliding (tandem hang gliding flight according to section A) or the organizer (activities according to section B) consider the first person to present a voucher to be entitled to use the service mentioned in the voucher. Swiss-Paragliding and the organizer have the right, but not the obligation, to check whether the presenter is in legitimate possession of the voucher and is entitled to receive the service. With the provision of the service to the first presenter, the claim of any subsequent presenter of a voucher with the same code is forfeited and there is no entitlement to compensation, even if the subsequent presenter can prove a better right to the voucher.
Vouchers are valid for two years from the date of issue. During this period, the risk of price increases for the service lies with Swiss-Paragliding (tandem paragliding flight according to section A) or with the organizer (activities according to section B). Vouchers can no longer be redeemed after the expiry date. If the service specified in the voucher is not used and carried out within this period, the voucher will be deemed to have been waived.
The vouchers cannot be exchanged or refunded. If the person presenting the voucher wishes to make use of a tandem paragliding flight (section A) or an activity of the same organizer (section B) other than those mentioned in the voucher, the value of the voucher will be credited in full. If the value of the voucher is higher than that of the desired tandem paragliding flight or activity, there is no entitlement to payment of the unused value of the voucher and the remaining balance is forfeited without replacement.
If the flying area is no longer available, Swiss-Paragliding can switch to another flying area.
If vouchers are ordered online (hereinafter referred to as "e-voucher"), the order will be confirmed to the customer by email. If the customer chooses the "invoice" payment method when ordering, the customer will receive the invoice with the confirmation email. The invoice amount is due for payment immediately.
Once payment has been received, the e-voucher will be sent by e-mail as a PDF file immediately, or within two to three working days if payment is made by invoice. The e-voucher can be redeemed once it has been printed out on white, previously unprinted normal paper in a minimum A5 format and in portrait format with a resolution of at least 600 dpi. The e-voucher must be presented to Swiss-Paragliding or the organizer in full and in minimum A5 format. E-vouchers that are not perfectly legible are invalid for redemption.
The e-vouchers are provided with a forgery-proof code. The customer acts abusively and with intent to enrich himself if he prints out the e-voucher more than once, duplicates it or forwards it with the intention of redeeming it more than once or having it redeemed by third parties. If Swiss-Paragliding discovers misuse, any e-vouchers that have not yet been redeemed will expire without compensation. Swiss-Paragliding reserves the right to claim damages.
Complaints in connection with the ordering of vouchers must be made in writing immediately, but at the latest within one week of receipt of the invoice or e-voucher, otherwise a waiver will be assumed.
2. transmission deficiencies
The customer shall bear the damage resulting from the use of electronic transmission methods, namely from loss, delay, misunderstandings, mutilation, illegibility and duplication, unless Swiss-Paragliding is guilty of gross negligence. Swiss-Paragliding shall not be liable for damages caused by disruptions or interruptions of any kind, in particular in telephone and Internet operations, provided that Swiss-Paragliding has exercised the usual care.
3. applicable law and place of jurisdiction
All legal relationships between the customer and Swiss Paragliding are subject exclusively to Swiss law. The place of performance and exclusive place of jurisdiction for all proceedings is Interlaken, Switzerland. However, Swiss Paragliding has the right to sue the customer in the competent court of his domicile or in any other competent court, whereby Swiss law remains applicable. Mandatory jurisdiction provisions of Swiss law shall take precedence.
4. final provisions
Should individual provisions of these GTC be or become invalid, this shall not affect the validity of the remaining provisions. An ineffective provision shall be replaced by a new provision that comes as close as possible to the economic and legal effect of the ineffective provision.
Agreements deviating from these terms and conditions require the express consent of Swiss-Paragliding and the written form. Swiss-Paragliding reserves the right to amend the GTC at any time. The GTC published on the Swiss-Paragliding website shall apply. The German version is authoritative.

General rental conditions
- Area of application
The bike rental services are provided by the company Swiss Paragliding & Adventure GmbH (hereinafter referred to as the Lessor) based in Interlaken , which is the owner of the rental bikes. The General Rental Terms and Conditions form an integral part of the rental contract. By signing it, the renter confirms that he has read these rental conditions and accepts them unconditionally:
- Contractual relationships
The contract is concluded between Swiss Paragliding & Adventure GmbH and the customer. Partners of the lessor act as intermediaries for the services.
- Bicycle takeover
The Hirer shall hand over the bicycle in a clean and safe condition. Complaints on the part of the Hirer must be reported to the Rental Firm when the vehicle is handed over. The hirer must provide official identification (identity card, ID card, GA travelcard, ½ tax card, driving license).
- Bike return
The Lessee is obliged to return the vehicle to the Lessor at the return point specified in the rental agreement during its opening hours before the end of the rental period specified in the rental agreement. The rental price for rental objects returned late or incorrectly parked as well as the resulting consequential costs shall be claimed from the Lessee. The vehicle and all accessories provided by the Rental Firm, such as keys, bicycle helmets, etc., must be returned to the Rental Firm in full and in perfect condition when the vehicle is returned. The Hirer will be charged for any loss or damage.
- Extension of the rental period
An extension of the tenancy is only possible with the consent of the landlord before the end of the current tenancy. The Rental Firm may refuse to extend the rental period without giving reasons. The rental price will be recalculated and the surcharge must be paid at the latest when the bike is returned.
- Minimum age of the tenant
Children and young people under the age of 16 must be accompanied by an adult. Children and young people under the age of 16 who are not accompanied by an adult may only be given rental bikes with the written consent of their parents or guardian.
The minimum age for riders of an e-bike with assistance up to max. 25 km/h is 16 years by law (14 years with a moped permit).
- Services and prices
The prices of the price list valid at the time of rental and published in the Lessor's brochure shall apply, including the discount provisions contained therein. Subject to printing errors. Discounts are only granted on presentation of the relevant ID. Discounts are granted on the spot and are not cumulative.
- Cancellation / Termination
A confirmed reservation can be canceled or adjusted free of charge up to 24 hours before the start of the rental period. Bookings canceled less than 24 hours before the start of the rental period will be charged at 100% in accordance with the applicable rates. In the event of rental interruption, there is no entitlement to reimbursement of the unused remaining rental period.
- Liability and insurance
9.1 Liability insurance
Insurance is the responsibility of the renter. By concluding the rental agreement, the renter confirms that they have liability insurance and therefore sufficient cover for the risks associated with riding the bicycle or e-bike. Liability also extends to damage costs such as expert costs, reduction in value or rental loss costs.
9.2 Defects during the rental period
In the event of defects during the rental period, the renter can exchange his bike for a vehicle of equal value.
In any case, the renter is responsible for the return transportation of the bicycle to the nearest possible return point.
9.3 Damage, theft and loss
The tenant is obliged to notify the landlord of any damage or loss that has occurred.
The hirer shall be liable for all damage caused to the rental object and its accessories during the rental period as a result of falling, vandalism, the effects of elements, manipulation, the effects of transportation and its improper or inappropriate use.
The costs for minor damage and loss of material will be charged to the customer by the rental company in accordance with the official price list.
The renter is liable for theft or loss of the rental object or accessories during the rental period. The vehicle must always be secured. The loss will be charged to the renter at replacement value.
If the Hirer hands over the vehicle to third parties, he/she shall be liable for any damage and consequential damage caused to the vehicle by third parties.
9.4 Accidents
Accidents and falls resulting in material damage must be reported to the landlord immediately. If persons are injured and/or property damage is caused to third parties or if a third party is involved as a possible (co-)perpetrator, the police must be called immediately and an accident report completed. A copy of this must be sent to the Lessor.
- Use / Prohibitions
The renter undertakes to comply with the Road Traffic Act and to use the bicycle properly and carefully.
The renter is responsible for all damage to the rented vehicle or third-party property resulting from negligence or improper use of the rented vehicle. Any misuse of the vehicle, the transportation of one or more additional persons on the luggage carrier and driving over obstacles where the vehicle could obviously suffer damage are not permitted.
The use of rental equipment for racing purposes is prohibited.
The use and wearing of the rental helmets provided free of charge is voluntary and at the user's own risk. The lessor accepts no liability in this matter.
- Applicable law and place of jurisdiction
All legal relationships between the customer and Swiss Paragliding.ch are subject exclusively to Swiss law. The place of performance and exclusive place of jurisdiction for all proceedings is Interlaken, Switzerland. However, the lessor has the right to sue the customer in the competent court of his domicile or in any other competent court, whereby Swiss law remains applicable. Mandatory jurisdiction provisions of Swiss law shall take precedence. - Final provisions
